Keith McCrea, a member of Sutherland’s Energy and Environmental Practice Group, has more than 35 years of experience in the energy field. He has appeared before the Federal Energy Regulatory Commission (FERC), U.S. Department of Energy (DOE) and other federal agencies as well as the courts in a wide variety of natural gas, electric power and oil pipeline matters. He also has broad experience in energy proceedings in a number of states, including California, New Jersey, North Carolina, Ohio, and Pennsylvania.
Keith advises clients before FERC on regulatory compliance issues associated with asset sales and acquisitions, market-based rate authorizations, market power analyses, price reporting and record retention requirements, and market behavior rules. He has extensive experience in FERC investigatory proceedings and other litigated matters, including market power issues, affiliate transactions and rate cases.
Keith’s practice includes counseling clients on regulatory and business issues associated with wholesale energy markets, regional transmission organizations, independent system operators, open access transmission tariffs, generation interconnection and transmission pricing. His recent work has involved siting and interconnection issues associated with large generation projects including solar and wind resources.
Keith is actively involved in California’s efforts to implement its climate change legislation (AB 32), renewable portfolio standards, and various demand response programs. He advises clients on similar developments at the federal level.
Keith’s appellate experience includes oral arguments before the U.S. Court of Appeals for the D.C., Third and Ninth Circuits and the Supreme Court of North Carolina.
