Sutherland Partner Peter G. Pappas is speaking on a Webinar, "Ariad v. Lilly: What Are The Lessons?", hosted by the Intellectual Property Owner's Association (IPO) on April 6, 2010.
On March 22, the U.S. Court of Appeals for the Federal Circuit reached an en banc decision in Ariad v. Lilly, a case that raised the question of whether patent law contains a written description requirement separate from the enablement requirement, and if so, asked what is the scope and purpose of that requirement. "Yes" was the court's answer to the first part of the question, but its opinion was more equivocal in the answer to the second part.
This Webinar brings together the opposing litigators who represented Ariad and Lilly, as well as the attorney from Sutherland who wrote the amicus brief to the Federal Circuit on behalf of IPO. The panelists will discuss the implications of the decision for both patent litigation and prosecution going forward.
