Herbert is one of the most recognized leaders in the legal and business communities in Georgia.
A senior transactional lawyer with a focus on representing the electric utility industry in complex financings, Herbert currently serves as interim General Counsel to the Oglethorpe Power Corporation. Oglethorpe Power is one of Georgia’s largest grossing companies, with annual revenues of more than $1 billion.
Herbert has represented electric utility clients in numerous financing deals, including publicly-issued bond offerings, leveraged leasing transactions, pollution control bond offerings, revolving lines of credit, government-guaranteed financings and commercial paper transactions.
In addition to his focus on the utilities industry, Herbert has substantial experience representing other corporation clients in corporate and securities transactions, including mergers and acquisitions, bond offerings and other financings.
Herbert also advises corporate boards and management on corporate governance issues, including Sarbanes-Oxley compliance, and regulatory matters before the Securities and Exchange Commission.
A distinguished leader in the business community, Herbert was the 2005 Chair of the Georgia Chamber of Commerce Red Carpet Tour, one of Georgia’s premier marketing and economic development initiatives. He was elected the 2006 Vice Chair of Economic Development for the Georgia Chamber of Commerce, and has served on the Board of Directors since 2001. Herbert is a former Trustee of Leadership Georgia.
Herbert was named a Georgia Super Lawyer by Atlanta magazine in 2004-2006, and was listed in Chambers, USA America’s Leading Lawyers for Business in 2005-2008.
He is a member of the Corporation, Banking and Business Law Section, the Public Utility Law Section, and the Electric Cooperative Bar Association of the American Bar Association. He is a past Chair of the Business Law Section of the State Bar of Georgia and a member of the Business and Finance Section of the Atlanta Bar Association.
Herbert earned his J.D., magna cum laude, in 1985 from the University of Georgia School of Law, where he was a member of Order of the Coif and Phi Kappa Phi. Herbert earned his B.B.A., summa cum laude and First Honor Graduate, from the University of Georgia in 1982.
