Health Care

The attorneys in Sutherland Health Care Practice Group represent a broad spectrum of health care providers and organizations that provide health care products and services to the health care industry. Our Health Care Practice Group attorneys are experienced in health care regulation, mergers and acquisitions of health care entities, managed care, health insurance, FDA regulation, third-party reimbursement, and federal grant and guarantee programs.

In today's increasingly complex legal and regulatory health care environment, providers need legal counsel with substantial experience in the health care industry to timely, effectively and efficiently meet their goals. Activities in the health care field, in addition to involving health care regulatory issues, frequently involve issues relating to tax, antitrust, third-party reimbursement, state certification and licensure, business and non-profit organization laws, contracts, finance and securities laws. Sutherland endeavors to provide our clients with the experience to meet these needs. This specific health care industry knowledge is complemented by our firm's national and international practice involving the general representation of business organizations, governmental agencies and non-governmental organizations.

Food and Drug Practice

Sutherland also has an active practice in food and drug regulatory law. Our clients in the field include both domestic and multinational manufacturers of products regulated by the U.S. Food and Drug Administration, such as pharmaceuticals, over-the-counter medications, medical devices, cosmetics, paperboard and plastic food packaging materials, animal feed additives, and substances used in food processing. We also represent manufacturers of controlled substances in both administrative and court proceedings involving the Drug Enforcement Administration.

Health-Related Financing Projects

Sutherland also has an extensive practice in secured financing transactions. As an example, we have recently completed a financing on behalf of a lender which provided funds to a business corporation owning two hospitals and a nursing home and managing three additional hospitals. Under the agreement, funds were made available to repurchase stock and to cover hospital operating costs. This project required dealing with financial institutions and regulatory agencies in Alabama, Arkansas and Tennessee and with the U.S. Department of Health and Human Services.
