Electric Power Producers

Sutherland maintains an integrated practice that provides legal support to independent power producers, power development companies, electric cooperatives and others owning or controlling electric generating assets.  Representation includes exempt wholesale generators, qualifying facilities, generation and transmission cooperatives, distribution cooperatives and industrials who self-generate.  Our activities on behalf of electric power producers include:

  • Acquisition and disposition of generating assets;
  • Greenfield and brownfield development of generating facilities;
  • Contract documentation for fuel supply and power sales;
  • Regulatory permitting and proceedings before FERC, other federal agencies and state public utility commissions;
  • Project finance and leveraged leasing arrangements;
  • General corporate representation;
  • Income tax matters;
  • Post commercial operation asset management;
  • Energy transaction taxes; and
  • Swaps and derivatives and related financial risk management.

Amidst recent turbulence in the merchant energy sector and the related challenges facing project developers and operators, Sutherland continues its diverse practice representing electric power producers.  A large group of our attorneys are devoted to serving this client group.  The diversity of our clients allows our attorneys to participate in a wide range of electric power transactions.  Sutherland monitors industry trends in order to respond to the ever changing and challenging environment in which electric power producers conduct their business.
