REPRESENTATIVE EXPERIENCE
Bill’s recent representative experience includes:
- Representing a textile manufacturer in a contract dispute with a private power plant developer over a cogeneration plant.
- Negotiating a development agreement for a private college regarding construction of a new on-campus steam energy plant.
- Negotiating an EPC contract for an international construction materials supplier regarding modifications to a cement plant.
- Representing a designer against a contractor regarding claims that process piping plans were defective for a new food manufacturing plant.
- Representing an EPC contractor on disputes arising out of the construction of a new coal-fired plant.
- Representing top national retail and mixed-use developers, such as The Sembler Company, Noble Investments and The Lane Company, in the drafting and negotiation of their design and construction contracts.
- Representing a joint-venture developer in the drafting and negotiation of a new high-rise hotel in downtown San Francisco.
- Representing the Milwaukee Metropolitan Sewerage District against a well-known engineering firm in a design-malpractice claim involving construction at a 300-foot deep, 32-foot diameter tunnel.
- Representing a private college against a general contractor who built a new academic center that suffered from substantial building defects. After several days of arbitration hearings, the case settled favorably for the college.
- Defending condo developers against a homeowner’s association alleging that the building leaked. After several mediation sessions, the matter settled favorably for the developers.
- Winning a motion to compel arbitration against a prospective class of condo homeowners claiming multiple construction defects in a high-rise condo project.
- Obtaining summary judgment for a top national engineering firm against an injured construction worker arising out of an accident on a highway bridge project on the grounds that the engineer had no legal duty to the worker.
- Representing the design team against claims involving the collapse of a seating section at Atlanta’s Philips Arena while under construction. The case settled favorably for the design team after several multi-party mediation sessions.
