REPRESENTATIVE EXPERIENCE Ben’s recent representative experience includes:
- Representing a large, public engineering firm in connection with multi-million dollar claims by a subcontractor for fraud, fraudulent misrepresentation, and breach of contract, and prosecution of claims for breach of contract and tortious interference against the subcontractor. This resulted in a summary judgment entered against the subcontractor and the subcontractor’s payment of a substantial portion of the engineering firm’s claims.
- Representing an electrical subcontractor in connection with a housing project in Georgia. The representation included prosecution of claims for balance of contract, pending change orders, impact damages, and defense of back charges, which resulted in payment of contract balance, change orders, and a substantial portion of the subcontractor’s impact costs. The general contractor’s back charges were completely rejected.
- Representing a construction manager against a mechanical subcontractor on a casino project in Las Vegas, Nevada. The representation included defense of multi-million dollar claims for impact damages, fraud, pending change orders, lost profits, and tortious breach of the covenant of good faith and fair dealing. The subcontractor’s claims were resolved for approximately 5 percent of their asserted value.
- Representing a structural steel subcontractor in connection with the construction of a university in Illinois. The representation included prosecution of claims for balance of contract, pending change orders, acceleration costs, and defense of back charges for alleged delay and defective work. This resulted in payment of the steel subcontractor’s contract balance, change orders, and a portion of acceleration damages. The general contractor’s backcharges were completely rejected.
In addition to resolving disputes, Ben advises clients on dispute avoidance, contract drafting, project issues, and various compliance issues. Representative examples include:
- Negotiating a $50 million design/build contract for an automated material handling facility project in Ohio.
- Negotiating a $35 million design/build contract for an automated material handling facility project in Sao Paulo, Brazil.
- Creating standard contract documents for a steel subcontractor in Illinois.
