Tracey Ledbetter counsels clients in the construction, insurance and financial services and energy industries on a wide range of matters.

Her experience includes defending class action lawsuits, handling complex business litigation and arbitration, advising on regulatory matters and compliance issues and drafting construction agreements.

Tracey has had some notable successes, including obtaining an extremely favorable settlement for an international engineering and construction company on disputes arising out of the construction of eight different power plants, winning a favorable outcome for the seller of a business in an action claiming breach of representations and warranties and obtaining a denial of class certification for a national insurance carrier in a matter arising out of auto subrogation claims.

Tracey is a member of the Georgia Asian Pacific American Bar Association, the State Bar of Georgia and the Atlanta Bar Association.

  • Advise contractors, engineers and architects on state-level licensing requirements.
  • Won dismissal of lawsuits by distribution cooperatives against two electric generation and transmission cooperatives seeking early termination of wholesale power contracts and withdrawal from membership.
  • Represent industrial contractor in dispute over installation of piping and structural steel involving claims for delay, disruption and defective engineering.
  • Represent data center client in drafting and negotiating construction contracts and revising suite of construction subcontracts.
  • Won dismissal of putative class action lawsuit against automobile insurance carrier challenging premiums in light of COVID-19 pandemic.
  • Represented international engineering and construction company on disputes arising out of the construction of multiple power plants, resulting in a favorable settlement.
  • Won in the US Court of Appeals for the Ninth Circuit Van Tassel v. State Farm (2021) defeating certification of a Rule 23 (b)(3) damages class action alleging underpayment of “diminished value” with auto insurance claims.
  • Defeated class certification in a suit claiming entitlement to recovery of diminished value from national property and casualty insurance carrier.
  • Won dismissal of a class action lawsuit against a Pennsylvania electric cooperative demanding distribution of patronage capital.
  • Represents cement producer in antitrust litigation involving allegations of price-fixing.
  • Currently representing automobile insurer in 16 putative class actions relating to total loss claim settlements.
