Matt represents clients on three interrelated fronts: government and internal investigations and litigation arising from workplace incidents and operational failures; labor and employment issues including worker classification, insurance and tax matters; and commercial matters including contractual, product liability, commodities trading and creditors’ rights disputes.
Matt was a core member of the team representing the international drilling contractor involved in the 2010 Gulf of Mexico Oil Spill in all facets of responding to the incident, including the ensuing governmental investigations and the multidistrict litigation, which resulted in a multi-month trial. Building on this experience, Matt created safetylitigation.com to help companies analyze key developments in safety-related litigation and regulatory activity. The site is not industry-specific but assists manufacturing, oil and gas, automotive, and mining companies, among others. As a member of Sutherland’s Crisis Management and Complex Litigation team, Matt advises companies on best practices in process safety and crisis management planning, and helps guide companies through internal and governmental investigations and response to incidents. Matt has helped clients navigate investigations by many government actors, including the U.S. Congress, the U.S. Department of Justice, states’ attorneys general, Occupational Safety and Health Administration, Bureau of Safety and Environmental Enforcement, the U.S. Coast Guard and an independent commission specifically appointed by President Obama to investigate the 2010 oil spill.
Matt has represented clients on employment and benefits issues in 46 states in civil litigation or in front of state departments of labor or revenue. These matters have involved issues related to worker classification, unemployment compensation, state tax liability, entitlement to insurance benefits, ERISA issues, the Fair Labor Standards Act and workers’ compensation.
Matt was born and raised in Charleston, West Virginia, and is an active member of the West Virginia bar. He has represented clients in West Virginia federal and state courts across a broad spectrum of issues, from disputed royalty payments on natural gas leases to the financing of a waste coal facility.
