Jesse Lincoln, a member of Sutherland’s Litigation Practice Group, focuses his practice on the construction industry and commercial litigation. He represents construction industry clients at all levels, including general contractors, subcontractors, and owners, in litigation and in transactions.
Jesse has varied construction litigation experience, handling disputes involving heavy industrial facilities such as power plants and cement manufacturing plants, mixed-use commercial developments, and technology projects involving power plant scrubbers, 4G LTE data networks, and sophisticated SCADA systems. His experience includes handling complex construction disputes in court and arbitration, including developing cases through depositions and document discovery, preparing detailed claims, representing clients in mediation, and trying cases through arbitration award or settlement.
Jesse also has extensive construction industry transactional experience, representing owners, contractors, and subcontractors at the front end of construction projects. Jesse prepares and negotiates design and construction contracts of all varieties and project delivery methods, including engineer-procure-construct (EPC) contracts, design-build contracts, design contracts, consulting contracts, and construction contracts and subcontracts. Jesse’s transactional work includes preparation and negotiation of contracts for industrial projects such as power plants and manufacturing facilities, large commercial projects involving construction on multiple parcels, and multi-family housing projects in various locations.
