Jana Nelson advises clients on a wide range of intellectual property matters, including patent portfolio strategies, patent and trademark procurement, technology transfers and licensing agreements. Jana also prepares and prosecutes domestic and international patent applications and provides opinions on patentability, non-infringement, validity and freedom-to-operate. The majority of her practice relates to the chemical, biotechnology, medical device and pharmaceutical industry sectors. In addition to working closely with examiners at the U.S. Patent and Trademark Office (USPTO) through telephonic and in-person interviews, Jana analyzes and frequently comments on new USPTO pilot programs, examination guidelines, rulemakings and policies. Her in-depth knowledge of these topics—particularly the new USPTO requirements under the America Invents Act—allows her to effectively advise clients and has made her a sought-after speaker.
Prior to joining Sutherland, Jana worked as a patent attorney in the chemical/biotechnology group of an IP boutique law firm in Virginia. Born and originally raised in Europe, Jana is fluent in Czech and Swedish.
Jana is admitted to the Virginia State Bar. Her work is supervised by District of Columbia bar members.
