WASHINGTON (July 12, 2004) – On May 12, 2004, the United States International Trade Commission (ITC) reversed the presiding administrative law judge's finding of a violation of Section 337 of the Tariff Act of 1930 by Sutherland Asbill & Brennan LLP client Bearings Limited in the Matter of Certain Bearings and Packaging Thereof, Inv. No. 337-TA-469. On June 30, 2004, the ITC issued the public version of its opinion explaining the decision.
In 2002, SKF USA, a subsidiary of Swedish-based AB SKF, filed a complaint to stop Bearings Limited and 13 other respondents from importing into the United States SKF bearings made by SKF affiliates in other countries and reselling them in the United States in competition with SKF USA. Bearings Limited led the other three remaining respondents (four other respondents had defaulted and six had settled before trial) in fighting the complaint all the way to the ITC. The ITC determined that Bearings Limited and the three remaining respondents had not infringed SKF USA's registered and common law trademarks and, therefore, had not violated Section 337.
