Sutherland Asbill & Brennan Draws Prudential VP and Former SEC Assistant Director Clifford Kirsch as Partner

May 31, 2006

NEW YORK (May 31, 2006) – Sutherland Asbill & Brennan LLP today announced that Clifford E. Kirsch, Vice President and Senior Corporate Counsel at The Prudential Insurance Company of America and former Assistant Director, SEC Division of Investment Management, will join the firm's Financial Services Group in New York, effective June 15, 2006.

Prior to his senior position at Prudential, Mr. Kirsch served as vice president and associate general counsel at Paine Webber's asset management subsidiary, and on the staff of the U.S. Securities and Exchange Commission, Division of Investment Management, in Washington, DC.  At the SEC, he held several positions including Assistant Director and was a recipient of the Manuel F. Cohen Younger Lawyer Award.

As Sutherland continues to expand its representation of broker-dealers and investment advisers, and the financial services industry on regulatory and enforcement matters, Mr. Kirsch's addition will greatly enhance the firm's position in the financial services market.

"The broker-dealer and investment adviser industries will continue to be the focus of significant regulatory scrutiny, creating a strong need for robust compliance programs and legal support," said Stephen E. Roth, Chair of the firm's Financial Services Practice Group.

Sutherland has experienced significant growth in its financial services practice in the last few years, hiring accomplished lawyers to expand its representation of broker-dealers and investment advisers, investment companies, and insurance companies.  Mr. Kirsch's experience will serve to expand and deepen the ability of Sutherland lawyers to provide compliance and regulatory services to these and other existing clients nationwide.

"Cliff's extensive work experience and valuable connections to the financial services community will be of tremendous value to the firm and to our clients as we continue to expand our financial services practice," said Sutherland's Managing Partner Mark D. Wasserman.

Mr. Kirsch serves as the editor of multiple treatises on financial services regulation, chairs an NASD advisory committee and several ALI-ABA and PLI  conferences on broker-dealer and investment management regulation, and is on the board of directors of the National Society of Compliance Professionals ("NSCP"), a leading organization for financial services compliance professionals.

"I'm excited to become a part of such a well-regarded financial services practice as Sutherland's," said Mr. Kirsch. "The firm has a premier practice and I believe that my ten-plus of experience as Chief Legal Officer of Pruco Securities, along with my work with the SEC and NASD, will be an asset to this group and the firm's clients, not only in New York, but nationally as well."
