Texas Keystone Appeal Could Force Eminent Domain Delays

Sutherland Partner Kent Sullivan was quoted in a recent Law360 article offering insight into a Texas court challenge that could delay development of the Keystone XL Pipeline.

Judge Sullivan, who previously served as a Justice for the Texas Court of Appeals, said the procedural scheme that allowed respondent TransCanada Keystone Pipeline to immediately seize the disputed land via eminent domain raises questions of constitutionality.
