State Supreme Court Says No to Tesoro Tax Refund

Eric S. Tresh, a partner in Sutherland's State and Local Tax (SALT) practice, offers insight in the article "State Supreme Court Says No to Tesoro Tax Refund," which appeared January 18, 2012, in the Skagit Valley Herald. The recent decision by the Washington Supreme Court – which rejected Tesoro Refining and Marketing Company's $2.5 million tax refund case – is receiving ample attention across the state of Washington due to its implications for fellow manufacturers. They are now subject to the court ruling that a particular business tax refund statute is only intended for wholesale and retail activity, not manufacturing.

According to Mr. Tresh, it’s a case unique to Washington, but part of a bigger picture of local and state departments of revenue reevaluating their tax policies to determine if they can generate greater revenue during slow economic times.
