Cisco Calls Patent Trolls Racketeers

November 11, 2012

A recent article in The Wall Street Journal, discussed the latest turn in Cisco Systems Inc.’s fight against Innovatio IP Ventures, LLC, a non-practicing entity (NPE) that purchases patents to make money through licensing and litigation. Cisco asserts that NPE patent infringement claims against the technology company’s customers are "misleading, fraudulent and unlawful" amounting to an extortion scheme that violates federal antiracketeering laws.

Sutherland Partner Ann G. Fort commented on the potential impact of Cisco’s strategy., She said, "A win by Cisco isn’t necessarily going to stop the NPE industry in its tracks, but it could halt some of the tactics used by NPEs, like going after companies’ customers."
