The U.S. District Court for the District of Columbia today issued a memorandum opinion and order upholding the Maritime Administration’s (MARAD’s) designation of New Jersey as an adjacent coastal state in the Safe Harbor Energy deepwater port licensing proceeding. Under the Deepwater Port Act, governors of adjacent coastal states have the authority to veto proposed deepwater port projects. In its memorandum opinion and order, the District Court upheld MARAD’s authority to designate adjacent coastal states, and found that Maritime Administrator Sean T. Connaughton’s decision to grant New Jersey’s request for such status was proper and supported by the facts on record.
