The U.S. Supreme Court Special Master assigned by the Court to hear a dispute between New Jersey and Delaware involving the proposed Crown Landing LNG terminal has reached the conclusion that New Jersey does not have exclusive control over a proposed pier that extends into Delaware. Special Master Lancaster stated that, because Delaware is the sovereign owner of the land involving the end of the pier, Delaware “is entitled to exercise police power jurisdiction over improvements extending into its own territory.” Officials from BP, the developer of the Crown Landing terminal, commented that they “don’t think [the decision] impedes the construction, but there are still questions to be answered.” The Attorney General’s office for New Jersey plans to ask the U.S. Supreme Court to reject the Special Master’s decision.
