In a letter to FERC released yesterday, the U.S. Coast Guard expresses its views on the current state of the regulatory review for the proposed Quoddy Bay and Downeast LNG terminals in Passamaquoddy Bay and requests additional information from the developers. Captain Stephen Garrity’s letter recognizes the important role that Canada must play with regard to the proposed terminals due to the transit of LNG vessels through Canadian waters, while at the same time highlighting the “nonsuspendable right of innocent passage” that exists in those waters. Garrity states that “[u]ntil the Coast Guard obtains the [additional] information … we consider both applications incomplete and will not be able to finish and submit the Waterway Suitability Report for either of the two projects.” The letter is available in the eLibrary under Docket Number CP07-35.
