New Jersey Granted Adjacent Coastal State Status Regarding Safe Harbor Energy

Maritime Administrator Sean Connaughton announced November 2 that “upon consideration of the NOAA recommendation, as well as the magnitude and scope of the proposed project and its potential for significant environmental impact to the State of New Jersey, I have determined that New Jersey is an Adjacent Coastal State as defined under the [Deepwater Port] Act,” regarding the Safe Harbor Energy LNG proposal. The letter announcing MARAD’s determination also notes that the governor of New Jersey will have authority to ensure that the project conforms to the environmental standards of New Jersey, and to collect fees to offset administrative costs.

Additionally, Sen. Frank Lautenberg (D-N.J.) expressed his approval of the decision, saying, “This was the right decision and it means New Jersey now gets a seat at the table in determining the future of this island.” His press release goes on to note that “A facility of this magnitude raises serious safety and security concerns which could have a devastating impact on the health and economy of New Jersey and the entire region.”
