Description
Defended a major highway contractor in connection with alleged Clean Water Act violations asserted by the Environmental Protection Agency in connection with the disposal of excess earthen material produced from construction of two highway projects in Rabun County, Georgia. We challenged the power of the federal government to regulate the alleged streams in which earthen material was placed, and we alleged that the Georgia Department of Transportation had environmentally cleared and approved the sites to receive the earthen material before any was placed.
