Description
Represented the owner of a newly constructed cement plant in Florida, in an arbitration against the contractor that built the plant. The contractor asserted extra work and delay claims of approximately $28 million. After a 13-day hearing, the arbitrators awarded the contractor less than 20% of its disputed claims (and nothing on the contractor's delay claims). Our client received further offsets for completion costs and contract credits for work not performed. The amount awarded to the contractor was approximately $4 million less than its bottom-line settlement demand prior to the arbitration.
