Description
Sutherland represented several clients with cases in the U.S. Tax Court, the U.S. Court of Federal Claims and the U.S. Court of Appeals for the Fifth Circuit. In each case, the IRS is relied on the gross omission exception to the normal three-year statute of limitations to assess tax. The principal argument was whether that exception applies. The United States Supreme Court ultimately rejected the IRS’ argument.
