DescriptionSutherland managed a series of 20 cases for a large insurance company contesting the status of its agents as employees under ERISA, which ultimately ended in the unanimous U.S. Supreme Court decision for the company in 1992. The economic realities test, used to determine whether a worker is an independent contractor or an employee under the FLSA, arises from this case (Darden).
