Represented an international manufacturer of replacement tires in an arbitration against the design builder of the client's manufacturing and warehouse facility. Our client asserted claims of approximately $4 million, including delay, defective work, failure-to-coordinate back charges and inadequate credits. The design builder counterclaimed with approximately $4 million of alleged contract balance and extra work claims, including alleged differing site conditions and site allowance overruns. In addition, both sides sought recovery of substantial attorneys' fees. The case involved 13 days of hearings and testimony by multiple expert witnesses, including geotechnical, mechanical and structural engineers. We succeeded in limiting the design builder to a recovery of only 12% of its disputed claims.
