City Bar Center CLE Program: Reinsurance & Regulations: Acquisitions of Insurance Assets & Risks
Sutherland Partner Earl Zimmerman is co-chair of a City Bar Center for CLE program entitled Reinsurance & Regulations: Acquisitions of Insurance Assets & Risks. The program will be held at the New York City Bar on Wednesday, March 3, 2010, from 9:00 a.m. to 12:00 p.m. Earl is moderating a panel on Buying a Block of Insurance Risks: Insurer to Insurer.
After a brief tutorial on Triple-X (life) and Cat Bond (P&C) fundamentals, the panel will analyze distressed scenarios and discuss solutions derived from recent experiences. Among other things, the panel will cover "fallen angels" as collateral; counterparty credit risk and deterioration; determining when an insurer or reinsurer is insolvent; commutation and recapture; the perspectives of sponsors, investors, monolines/credit support providers, and regulators on these matters; and duties of directors and controlling creditors.
For more than a decade, risks traditionally covered by insurance products have also been transferred using securities and other financial products. At the same time, secondary trading in life insurance policies, with its implications for capital markets and hedging strategies, has fundamentally challenged traditional notions of "insurable interest." Clearly the line between insurance and other financial products has been blurred. This program will explore the structure, uses and regulation of various insurance-linked financial products, providing practical advice and focusing on recent legal and market developments.
