Sutherland Partner Malvern U. (Griff) Griffin is speaking at a PLI event entitled "Patent Litigation 2010" on November 8-9, 2010, at the AMA Executive Center in Atlanta, Georgia. Griff's topic will be "Opinion Letters." Whether opinions of counsel are necessary or desirable after Knorr-Bremse remains an open question. This session will cover the standard of proof of willfulness after In re Seagate Technology and Broadcom v. Qualcomm, whether an opinion should be obtained, whether to waive the privilege and the scope of the waiver.
Rapid changes in patent law make it necessary for both plaintiff's and defendant's counsel to remain up-to-date on the current state of the law and on how to develop successful litigation strategies and tactics.
