|Sutherland Partner Jerome B. Libin is speaking at the International Bar Association's Annual Conference, October 3-8, 2010, in Vancouver, Canada. Jerry is the chair of a session on "Tailoring dispute resolution strategies for tax positions involving multiple jurisdictions."
This panel will address when to seek competent authority mutual agreement procedures, how to approach competent authorities, when and how to keep limitation periods open, what actions in one jurisdiction may give rise to an adverse admission in another jurisdiction, whether and how a case may be settled in one jurisdiction without limiting access to competent authority or to the courts of another and the nature of any limitation, how the newly adopted country-to-country arbitration provisions may change the calculus of particular procedural remedies, and the significance of foreign country legal advice on the sustainability of local positions, eg the US compulsory tax regulations.
